同一労働同一賃金・・・中小企業も４月１日より適用されます。

○パートタイム・有期雇用労働法の適用について

　２０２１年４月１日より、中小企業でも正社員と非正規労働者（短時間労働者・有期雇用労働者）との間の不合理な待遇差の解消、所謂「同一労働同一賃金」が求められます。

 

基  本  給・・・労働者の「①能力・経験」、「②業績・成果」、「③勤続年数」に

　　　　　　　応じて支給する場合は、①、②、③が同一であれば同一の支給をし、

　　　　　　　違いがあれば違いに応じた支給をする。

 

賞　　与・・・賞与（ボーナス）であって、会社の業績等への労働者の貢献に応じて

　　　　　　　支給するものについては、同一の貢献には同一の、違いがあれば違いに

　　　　　　　応じた支給を行わなければならない。

 

各種手当・・・短時間労働者・有期雇用労働者にも正社員と同一の支給をする必要がある。

 

その他上記以外の待遇も、不合理な待遇差の解消が求められます。このため、労使
で、それぞれの事情に応じて、十分な話し合いをしていくことが望まれます。
